1. Service identity

ALQUILERY is a digital platform dedicated to brokering and managing reservations for vehicle rentals without drivers and tours in Cozumel, Quintana Roo, Mexico.

ALQUILERY does not own the vehicles, nor does it directly provide rental or tour services, acting solely as an intermediary, manager, and commission agent between the customer and independent service providers.

2. Acceptance of the terms

Access, use, quotation, reservation, or payment made through the website https://alquilery.com.mx and WhatsApp in the contact list implies that the user has read, understood, and expressly accepted these Terms and Conditions.

Electronic acceptance is fully valid under Mexican law and the Federal Consumer Protection Act.

3. Nature of intermediation

ALQUILERY facilitates:

The price of the service

Reservation management

Payment channeling

Communication between customer and supplier

The vehicle rental agreement is entered into directly between the customer and the supplier at the time of vehicle delivery.

4. Suppliers

The services are provided by independent third parties, which may include, but are not limited to:

GM, JM, Chacal, Isla Bonita, Medprez, Sunset, Darth, and other providers available at the time of booking.

ALQUILERY has no operational control over these providers.

5. Booking process

The reservation is considered confirmed once the corresponding payment has been made and confirmation has been sent by ALQUILERY.

Rates, requirements, deposits, insurance, and conditions depend on the selected provider.

The user is responsible for providing accurate and up-to-date information.

6. Payments

Payments made through ALQUILERY correspond to management fees, brokerage commissions, or advance payments, as applicable.

Payments can be processed through external payment platforms.

In the case of payments in foreign currency, the amount may be reflected in Mexican pesos according to the exchange rate applied by the payment platform.

7. Billing

ALQUILERY only invoices items corresponding to its intermediary services, when applicable and in accordance with current SAT regulations.

Vehicle rental and additional charges must be invoiced directly by the supplier, if requested by the customer.

8. Vehicle delivery / tour reception 

The delivery and return of the vehicle is carried out directly between the customer and the supplier, who may require official identification, a valid license, a security deposit, and/or a credit card.

To take the tour, you must meet with the provider at the locations specified in the contact information provided.

9. Liability

ALQUILERY is not responsible for:

• Damage, accidents, theft, or loss of the vehicle
• Supplier non-compliance
• Additional charges determined by the provider
• Operational decisions by the supplier
• Claims relating to the use of the vehicle should be addressed directly to the relevant supplier.

10. Cancellations

Cancellation and modification policies depend on the provider and the type of rate contracted.

ALQUILERY's management fees or commissions are non-refundable, unless expressly stated otherwise.

Failure to arrive at the agreed time, place, and date will result in the loss of your reservation.

11. Use of the site

The user agrees to use the website lawfully and to refrain from making false reservations, fraudulent use, or activities that harm ALQUILERY or its suppliers.

12. Data protection

Personal data will be processed in accordance with the Privacy Notice and applicable Mexican law.

13. Refunds

Alquilery is only responsible for the payment made for the reservation service management. Amounts paid for rental and tour services to suppliers, supplier representatives, and even to Alquilery on behalf of the supplier are not covered by this refund policy, and only the supplier can govern it.

100% of the service fee paid for reservation management will be refunded when:

The weather makes service impossible and endangers customers.

The customer has serious health problems, and these are confirmed by a medical report, prescription, or are visible to the naked eye.

The customer cancels 24 hours before the scheduled arrival time.

Alquilery and its suppliers are unable to provide the service due to a lack of vehicles. Where possible, Alquilery will offer options of the same or higher value, with any adjustments to be borne by the customer.

13. Legislation and jurisdiction

These Terms and Conditions are governed by the laws of the United Mexican States.

For any dispute, the parties submit to the competent courts of Cozumel, Quintana Roo.
